Information on the processing of personal data
pursuant to Articles 13-14, Regulation (EU) 2016/679

Argotec S.r.l. (hereinafter, for brevity, the “Company” ), as the Data Controller, wishes to inform you, pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 on the protection of personal data (“Regulation” or “GDPR”) and the applicable national legislation, including any specific measures issued by the Italian Data Protection Authority (“Garante Privacy”), that the personal data you provide during the interview and selection process will be processed in compliance with the current legislation and contractual provisions, for the purposes and in the manner set out below.

1. Data Controller – Identity and contact details

2. Type and source of personal data

The Company will primarily process the following categories of personal data:

identifying and contact data (such as, for example, name, surname, date of birth, tax code, address, phone contacts, etc.).
date relating to previous work experience (such as, positions held, dates of employment, role in the company, salary and benefits, periodic evaluations, other data relating to work experience), professional qualifications and professional information published by the candidate;
tax and income data (such as tax code, salary);
data provided through the submission of a curriculum vitae (such as, for example, images on the curriculum vitae) and other data collected in the course of personnel selection and assessment activities;
data revealing state of health (documentation concerning a disability situation or membership of a protected category);
any other personal data provided by the candidate.

3. Purposes, legal basis for the processing and nature of the provision

The purposes for which the personal data contained in your CV and provided by you during the interview are collected and processed are related to the creation of a database from which to select candidates for possible recruitment; therefore, the same data will be processed by the data controller exclusively for the purposes inherent to personnel selection procedures, for the possible performance of activities prior to the conclusion of the employment contract and for compliance with legal provisions.
Pursuant to Article 6, paragraph 1, lett. b), c) and f) of the Regulation, the provision of your data for the above-mentioned purposed not require your consent.
The provision of your personal data is mandatory to carry out activities related to the selection of personnel and failure to provide such data will mean that the Company will not be able to consider your application as part of a selection process.

4. Methods of data processing

Your personal data will be processed by the Company and authorized parties using both electronic and manual systems, in accordance with the principles of fairness, lawfulness, and transparency set forth by the applicable data protection legislation, safeguarding the confidentiality and rights of the data subject through the adoption of appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
As part of the selection activity, the Company may carry out verification of the information provided (e.g. academic qualifications and previous employers) for the sole purpose of verifying the information received.

5. Recipients and transfer of personal data

Your personal data may be disclosed to third parties which the Company uses for the management of the selection process, with whom service contracts have been entered into. These parties act based on the instructions received from the Data Controller, as Data Processors pursuant to Article 28 of the Regulation. A complete list of the Data Processors under Article 28 of the Regulation is available from the Data Controller, who can be contacted using the details provided above.

Your personal data will not be transferred to countries outside the European Union; however, if for specific needs it becomes necessary to transfer data to countries outside the EU, including those that do not provide adequate protection, the Company undertakes to ensure appropriate levels of protection and safeguards, including contractual measures, in accordance with applicable regulations, including the adoption of standard contractual clauses. 6. Data retention period

Your personal data will be processed and retained only for the time necessary to fulfil the purposes for which they were collected.
If, at the end of the selection process, a job offer is not made or not accepted, your personal data will be retained for a maximum of 12 months from the closing date of the selection process.
Your personal data will also be kept for this period in order to be able to prove, in the event of a dispute, that we have conducted the selection and recruitment processes in a non-discriminatory, fair and transparent manner.
Personal data functional to the fulfilment of civil and fiscal obligations will also be retained thereafter, in compliance with the retention periods provided for by the applicable regulations.
At the end of these periods, personal data will be deleted and/or destroyed.

7. Data subject’s rights

The data subject may exercise, in relation to the data processing described herein, the rights provided by the GDPR (Articles 15-21 and 77), including:

to receive confirmation about the existence of his or her personal data and access their content (right of access);
to update, modify and/or correct personal data (right to rectification);
request the erasure or restriction of the personal data processing of data processed (right to restriction and to erasure “right to be forgotten”);
to object to the processing (right to object);
to withdraw the consent, where given, at any time without prejudice to the lawfulness of the processing based on the consent given before its withdrawal;
to lodge a complaint with the Italian Data Protection Authority in case of violation of personal data protection regulations;
to receive a copy of data in electronic format concerning him or her rendered in the context of employment contract and request that such data be transmitted to another Data Controller (right to data portability).
